New Zealand Bars Luck and Ritual Themes in Online Casino Ad Guidance

New Zealand's Department of Internal Affairs has published detailed guidance that bars online casino advertising from using themes of luck, fate, or ritual, part of a strict marketing regime for licensed operators issued in July 2026.

The guidance fills in the operational detail of the Online Gambling Regulations 2026 and the Online Casino Gambling Act, which came into force on 1 May 2026, spelling out what operators and advertisers may do before the online casino licensing process concludes.

Advertising to New Zealanders remains prohibited until operators are licensed. The department can now issue takedown notices and penalties of up to NZ$5 million against anyone who publishes, or arranges to publish, an unlawful online casino advertisement, including platforms that carry advertising on behalf of a provider.

The guidance sets out content that is off limits. According to the departmental guidance, advertisements must not appeal to people under 18, use cartoons, mascots, or youth-culture music, or draw on superstition by suggesting that luck, fate, or rituals influence a gambling outcome.

Operators may not present gambling as a route to financial success, and cannot use the word 'Win' or the '$' symbol unless these refer to a specific prize that has been determined or is payable. Advertising jackpots is prohibited outright.

Advertisements must not suggest that luck, fate, or ritual can influence a gambling outcome, or present gambling as a way to achieve financial success.

On placement, advertisers must assess likely audience demographics and avoid any medium where minors could make up more than 20% of possible viewers. Advertising is banned near schools and youth events, and operators must disable automated audience-expansion features that could widen reach to under-18s.

Marketing must not target anyone under 25 unless the operator can demonstrate age-verification and exclusion systems effective at blocking under-18 access. For live broadcasts, a wait period bans advertising from 30 minutes before to 30 minutes after an event.

The regime also prohibits paid endorsements and affiliate marketing, including the use of social media influencers, and makes operators liable for breaches committed by third parties they contract with. The rules form part of the country's move towards a regulated online casino market.

The restrictions flow from a decision to allow limited advertising only once a licensed market is running, balancing the aim of steering players towards regulated operators against a legal requirement to protect children from gambling harm. Sponsorship, paid endorsements and affiliate marketing were ruled out at Cabinet level in late 2025.

The department has said it will judge an advertisement on its overall effect, weighing wording, imagery, audio and sequencing rather than any single element, and will treat content that encourages excessive, impulsive, or continuous play as a breach of the rules.

The requirements will apply to up to 15 operators expected to be licensed once a three-stage process concludes in early 2027. Until then, the advertising ban stands, and the department has said it is working with social media, technology, and media platforms to enforce the prohibition in the meantime.
