Cork Casino Operator Wins Appeal Over Cobh Gaming Arcade Conditions

A casino operator in east Cork has won an appeal against planning conditions that would have limited its new gaming arcade to five years and capped its opening hours at 8pm.

Wonderboy Amusements Ltd, which shares owners with Coalquay Leisure Limited, had been granted conditional permission in December 2025 for a four-storey development at a seafront site accessible from West Beach and Rahilly Street in Cobh. The ground floor was approved for a "gaming/amusement arcade", with four apartments on the floors above.

Council's 18 Conditions Rolled Back on Appeal

Cork County Council had attached 18 conditions to its original approval, including noise restrictions and rules specific to the gaming floor. Two of those conditions limited the arcade permission to five years and restricted opening hours to between 10am and 8pm.

Wonderboy Amusements appealed the conditions to An Coimisiún Pleanála, the national planning appeals body. The commission has now directed Cork County Council to remove the five-year time limit, finding it was not justified, and to extend permitted opening hours to 10pm.

An Coimisiún Pleanála ruled the extended hours were "in accordance with the Cork County Development Plan 2022-2028 and the proper planning and sustainable development of the area."

The original planning file pointed to the nearby Liberty Casino at Pearse Square as a premises with a "similar use" to the proposed arcade, and cited the county development plan's recognition of the role recreation, leisure and the night-time economy play as town-centre retail contracts.

Part of a Wider Pattern Across Cork

The Cobh case is the latest in a series of contested arcade applications linked to the same ownership group. Cork County Council recently refused to let Coalquay Leisure add a gaming arcade to a planned café in Midleton, though it approved an accompanying five-bedroom apartment unit.

In Ballincollig, Coalquay Leisure's "gaming/amusement arcade" application was initially refused by the council before the decision was overturned on appeal in October, following a local protest in November 2025. Cork City Council separately wrote to the company urging it not to proceed with that development.

Cork County Council has not indicated whether it will issue further guidance on arcade conditions following the Cobh ruling.

An Coimisiún Pleanála, formerly known as An Bord Pleanála, is the independent body that hears appeals against local authority planning decisions across Ireland. Its rulings on commercial gaming and amusement arcade applications have become increasingly significant in coastal and city-centre locations, where operators have repeatedly challenged conditions that local councils attach to protect residential amenity and limit the concentration of gambling premises.

Cork has seen a cluster of these disputes over the past year, with arcade and amusement-centre applications contested in Cobh, Midleton and Ballincollig all involving companies under common ownership. The pattern has drawn attention from residents' groups and at least one city council, which wrote directly to Coalquay Leisure Limited urging it to abandon a contested development rather than pursue it through appeal.

Coalquay Leisure already operates several casinos in Cork city centre, and the Cobh site's planning file drew a direct comparison to one of those existing venues, Liberty Casino, when arguing the proposed arcade represented a similar, already-established use for the area. That comparison appears to have carried weight with planners assessing whether the extended opening hours were appropriate.
